By accessing or using the Matatu Evolution mobile application ("App") and website at matatuevolution.com ("Website"), collectively referred to as our "Services," you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our Services.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our Website. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.

You may use our Website for lawful purposes only. You agree not to use the Website in any way that violates any applicable federal, state, local, or international law or regulation. You agree not to:

• Use the Website in any manner that could disable, overburden, or impair the Website.
• Use any automated device, process, or means to access the Website for any purpose.
• Introduce any viruses, trojan horses, worms, or other harmful material.
• Attempt to gain unauthorized access to any portion of the Website or any systems connected to it.
• Scrape, mine, or otherwise collect data from the Website without permission.

Matatu Evolution is provided for personal, non-commercial entertainment use. You may download and use the App on devices that you own or control, subject to these Terms and the applicable app store terms of service.

You agree not to:

• Modify, adapt, translate, reverse engineer, decompile, or disassemble the App.
• Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software.
• Exploit the App for any commercial purpose without our express written consent.
• Interfere with or disrupt the integrity or performance of the App or its servers.
• Create derivative works based on the App.

When using our Services, including multiplayer features and any community areas, you agree to:

• Treat other players with respect and sportsmanship.
• Not use offensive, threatening, abusive, or hateful language or content.
• Not harass, bully, or intimidate other users.
• Not impersonate any person or entity or misrepresent your identity.
• Not engage in any form of cheating, exploitation, or unfair gameplay practices.
• Not share inappropriate, offensive, or illegal content.
• Report violations and inappropriate behavior through proper channels.

We reserve the right to suspend or terminate access to our Services for any user who violates these conduct guidelines, at our sole discretion and without prior notice.

All content, features, and functionality of our Services — including but not limited to the game design, graphics, artwork, animations, sound effects, music, text, logos, trademarks, code, and user interfaces — are owned by Matatu Evolution or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The Matatu Evolution name, logo, and brand marks are trademarks of Matatu Evolution. You may not use these marks without our prior written consent, except for factual references to the product.

The Matatu Evolution Designer Marketplace allows approved designers to submit custom card skin designs for potential inclusion in the game. By submitting content to the Marketplace, you represent and warrant that:

• You are the original creator of the submitted content and own all rights to it.
• Your submission does not infringe on any third-party intellectual property rights.
• Your submission complies with our content guidelines and quality standards.
• Your submission does not contain offensive, discriminatory, or inappropriate content.

By submitting content, you grant Matatu Evolution a non-exclusive, worldwide, royalty-free license to display, distribute, reproduce, and sell the submitted designs within the App and related marketing materials. You retain ownership of your original artwork, subject to the licensing terms outlined in the Designer Marketplace agreement.

For feature suggestions, feedback, and other non-marketplace submissions, you grant us the right to use, implement, and incorporate your ideas into our Services without obligation of compensation or attribution.

Matatu Evolution may offer optional in-app purchases, including cosmetic card skins. All purchases are processed through the applicable app store (Google Play). Purchases are subject to the app store's terms and refund policies. In-app purchases are non-transferable and may only be used within the App.

Purchased items are cosmetic only and do not provide any competitive gameplay advantage. We reserve the right to modify, discontinue, or change the pricing of items at any time.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee that our Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee any specific results from the use of our Services. Your use of our Services is at your sole risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MATATU EVOLUTION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use our Services.
• Any unauthorized access to or alteration of your data or transmissions.
• Any statements or conduct of any third party on our Services.
• Any other matter relating to our Services.

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your right to use our Services will immediately cease. You may also terminate your use of our Services at any time by uninstalling the App and ceasing to visit the Website.

In the event of termination, sections relating to intellectual property, disclaimers, limitations of liability, and governing law shall survive.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts located in Kampala, Uganda.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
